EPA Issues Proposed Interstate Air Quality Rule Affecting 29 States and Announces Upcoming Public Hearings

On January 30, 2004 EPA proposed an Interstate Air Quality Rule which is intended to reduce interstate transport of fine particulate matter and Ozone (Federal Register, 69 Federal Register 4565-4614 (January 30, 2004). The proposal finds that 29 States and the District of Columbia contribute significantly to non-attainment of the National Ambient Air Quality Standards (NAAQS) for fine particles (PM 2.5) and/or 8-hour ozone in downwind States. EPA is proposing to require upwind States to revise their State Implementation Plans (SIPs) to include control measures to reduce emissions of sulfur dioxide (SO2) and/or nitrogen oxides (NOx). On February 2, 2004, EPA published the dates and locations (although detailed information for the meetings (sites, times, etc) will be posted in EPA’s websites as they become available) for the public hearings for this proposed rule and other associated rulemaking proposals: February 25 and 26, 2004 in Chicago, IL; Philadelphia, PA; and the Research Triangle Park, NC (all simultaneous meetings
